Restrictive Covenant

 

    

The following is a list of the requirements taken from

the Restrictive Covenant that is in place to protect all

owners of Whitetail Ridge Estates. 



(a)The minimum above grade square footage of the dwelling not including a garage shall be:

a.1900 square feet;

b.Exception to this allowed for Bungalow and Bi-level split designs which shall be a minimum of 1600 square feet;


(b)The Lots shall not be subdivided at any point in the future and only one dwelling may be constructed or exist on a Lot at any given time;


(c)During the first three years from the date of registration of this Restrictive Covenant, no Dwelling or other building shall be erected on the Lots unless the proposed building plans are submitted to the Developer for its approval, and the Developer has communicated its approval in writing;


(d)The Lots shall be used for private residential purposes only, and no Dwelling designed for more than one family shall be erected on the Lots;


(e)No Dwelling shall be used for any other purpose than that of a private dwelling for a single family, however discrete home based businesses are allowed provided they do not attract excessive amounts of traffic;


(f)Any building built on a Lot separate and apart from the principal Dwelling and having a floor square footage in excess of 200 square feet shall have the same exterior style, finish, and colour of the principal Dwelling;


(g)A minimum of stone or brick accents are recommended on the exterior finish of the Dwelling;


(h)A functioning driveway post light at the approach (driveway entrance) shall be installed.  The lot number shall be displayed on this post light or in another equally attractive manner.


(i)Mobile homes or trailers are not permitted;


(j)Storage or parking of commercial vehicles in excess of 1 ton, machinery, equipment, stockpiling materials, supplies, stock-in-trade or products is not permitted, except where the presence of the before mentioned items is temporary and associated with the construction, maintenance, or repair of a Dwelling or its utilities;


(k)Livestock are not permitted;


(l)Barb wire fencing is not permitted;


(m)Construction of the Dwelling must commence (minimum of foundation) within one year of a building permit being available for request;


(n)Construction of the Dwelling shall be completed within two years of a building permit being available for request and must be completed by the original buyer prior to resale of the Lot;


(o)Initial landscaping to bring the Lot up to a presentable standard shall be completed within three years of a building permit being available for request;


(p)All lots are required to leave the 20m of their lot bordering existing Lots along Rge Rd 412 in its natural state except for the removal of dead fall.


(q) Vehicles, motor homes, recreational vehicles, trailers, boats, snowmobiles or similar vehicles may be stored on the lot in a manner that is in keeping with the aesthetic appearance of the subdivision.  All of the before mentioned items must be functional and in good repair.  Lots will not resemble the appearance of a junkyard.


(r)The owner of a Lot shall be responsible for all damage to the existing roads or rights-of-way caused by contractor’s vehicles or equipment during construction, and also for the clean up of all mud, concrete or debris on the road or street resulting from work performed by or on behalf of the owner.
